01Private use & supply
Personal possession and supplying other people are different legal questions.
Spain’s Health Ministry distinguishes possession for personal use from drug trafficking. That distinction is not a general authorisation to distribute cannabis through a club.
Article 368 of the Criminal Code covers illicit cultivation, production, trafficking and conduct that promotes or facilitates unlawful drug consumption. Whether particular conduct is criminal depends on the facts.
02Streets & public transport
Public possession can be an offence even without an intention to sell.
Article 36.16 classifies unlawful consumption or possession in public places, streets, public establishments and collective transport as a serious administrative offence. Article 39 sets a €601–€30,000 range for serious offences; this is a statutory range, not a prediction of an individual fine.
03A membership card is not a licence
A fee, a registration or an invitation does not settle legality.
In a 2018 Barcelona case, the Supreme Court upheld convictions involving an association used to distribute cannabis. Recording visitors as members and charging an initial fee did not make that activity lawful.
SmokeUp cannot infer legal visitor eligibility from an age check, a membership fee, a social account or a club’s own assurance. Rules quoted by a particular association are not automatically Spanish law.
04Check the date of old guides
Catalonia’s 2017 association law was annulled.
The Constitutional Court’s judgment 100/2018 declared Catalonia’s Law 13/2017 unconstitutional and void. A travel article that treats that law as a current operating licence is relying on an annulled framework.
This judgment does not by itself determine the present legal status of every individual association. SmokeUp has not verified individual Barcelona clubs.
05Protect your identity documents
Understand why a copy is needed and how it will be protected.
Spain’s data protection authority says unnecessary details may be masked when a complete ID copy is not strictly necessary. For electronic copies, it advises against email and says the organisation should provide a secure method.
SmokeUp does not collect identification documents or arrange club membership.
06Keep driving separate
Feeling sober is not a reliable legal test.
Spain’s Road Safety Act prohibits driving with drugs present in the body. It provides an exception for prescribed therapeutic medicines only when the driver remains fit to drive safely. Articles 77 and 80 and Annex II set a €1,000 fine and six licence points for the drug-presence offence. Do not drive after using cannabis.
